On Saturday August 24th, the Canadian Industrial Labour Board (CIRB) had issued its decision that both rail lines at CPKC and CN and Teamsters Canada Rail Conference (TCRC) employees are to resume operations and return to work on Monday August 26th.
What does this mean for you?
During the work stoppage, we promptly activated our contingency plan by securing road transportation or continuing to pick up freight and load containers, preparing for when the railways reopened. Today, we are pleased to announce that operations with CPKC have resumed, and freight movement has resumed.

August 24 – TCRC Bargaining Update
CPKC moves to restart rail operations following CIRB order
CPKC today said it will restart railway operations in Canada by 00:01 ET on Monday, Aug. 26, following the Canada Industrial Relations Board (CIRB) order requiring CPKC to resume operations and Teamsters Canada Rail Conference (TCRC) employees to resume their duties.
CPKC will fully comply with the CIRB order. As such, CPKC is ending the lockout initiated on Thursday, Aug. 22. CPKC has asked the TCRC for employees to return to work for the day shift on Sunday so that we can get the Canadian economy moving again as quickly as possible and avoid further disruption to supply chains.
Our team is executing its restart plan for the safe and orderly resumption of rail service across Canada. We are working with customers on a balanced return to normal operations.
The CIRB will be convening a case management meeting with the parties Thursday, Aug. 29, to discuss the imposition of final binding interest arbitration.
As specified in the CIRB’s order, the existing collective agreements between the company and the union are in force.
The CIRB’s order was issued following the Canadian Minister of Labour’s direction on Thursday, Aug. 22, pursuant to his authority under Section 107 of the Canada Labour Code.
CPKC looks forward to welcoming all of our Canadian locomotive engineers, conductors, yard persons and dispatchers back to work. We are focused on restoring our railway to full strength as we get back to serving our customers and moving Canada’s trade and commerce throughout North America.
The CIRB order ends months of unnecessary uncertainty and disruption for the Canadian economy and North American supply chains. We anticipate it will take several weeks for the railway network to fully recover from this work stoppage and a period of time beyond that for supply chains to stabilize.
The Teamsters union served strike notice to CPKC, and CN Rail issued a lock out notice. Both CPKC and CN Rail have been halting shipments in preparation for potential work stoppages. Unless all parties can reach a last-minute agreement, workers will be off the job as of 12:01 am EST on Thursday August 22nd. In the event of a work stoppage, all rail lines across Canada will cease operations, resulting in a halt of all shipments via the railways.
What does this mean for you?
As a customer of Fastfrate, we have developed a contingency plan for you and your operations. Although no shipments can be moved via the railways, we have a few options that will help mitigate congestion within your operations.
Fastfrate terminals in Vaughan, Montreal, Calgary, Edmonton, Winnipeg, Regina and Vancouver will continue to pick up your freight, this will help clear your docks and keep your operations moving, we will continue to pick up freight, stage and load them. We can stack containers in our yard or CPKC’s yard, and we will stack them by date received to ensure that once the rail lines are operational, we will operate on a first in, first out model.

Shipping with CPKC:
Effective 23:59 local time today, Wednesday August 14th, 2024, CPKC will NOT accept any intermodal loaded containers classified as dangerous goods (across all class codes) for domestic and international traffic at any inland terminals. This applies to shipments destined for Canada or originating from any Canadian port or customer location.
Shipping with CN:
CN will be implementing an embargo on all temperature-controlled Intermodal traffic across their network, effective August 15. The exact timing is dependent on origin and destination. Additionally, CN will embargo all Intermodal traffic destined to all points in Canada from U.S. origins or U.S. interchange, effective August 16. UPDATE ON TCRC COLLECTIVE BARGAINING NEGOTIATIONS
CPKC to issue TCRC lockout notice for Aug. 22
CPKC today said it will issue notice to the Teamsters Canada Rail Conference (TCRC) – Train and Engine (T&E) division and TCRC – Rail Traffic Controller (RCTC) division of its plan to lock out employees at 00:01 ET on Aug. 22 if union leadership and the company are unable to come to a negotiated settlement or agree to binding interest arbitration. CPKC is committed to continuing good faith negotiation throughout.
The decision to issue a lockout notice comes after the Canada Industrial Relations Board (CIRB) on Friday issued its decision determining that no services need to be maintained during a railway strike or lockout in order to protect Canadian public health and safety. The CIRB also ordered a 13-day extension of the cooling off period which ends on Aug. 22. Following the expiration of the cooling off period, a legal strike or lockout involving the TCRC – T&E or TCRC – RCTC could occur.
All stakeholders want an end to this needless uncertainty as rapidly as possible so that we can continue serving the North American economy. Stability could be restored today if the TCRC would accept CPKC’s offer to resolve the current labour dispute through binding interest arbitration.
If no resolution is reached during bargaining through the extended cooling off period, and the TCRC continues to refuse binding interest arbitration, CPKC will have no choice but to take this action. CPKC is acting to protect Canada’s supply chains, and all those who depend on them, from the more widespread disruption that would be created should a work stoppage occur during the fall peak shipping period. Delaying resolution to this dispute only makes things worse, causing more disruption and damage to Canada’s international reputation as a reliable trading partner.
CPKC provides this public notice to mitigate uncertainty and give our customers and supply chains proper time to plan for a safe and orderly shutdown of railway operations. As part of those preparations, CPKC will issue an embargo for all toxic by inhalation (TIH) dangerous goods traffic to allow this traffic to safely exit the rail network prior to a work stoppage. Other embargoes will be issued during the cooling off period, as necessary.
CPKC remains committed to doing its part to avoid a work stoppage. In response to opposition from TCRC leadership, CPKC has advised the union representing conductors and locomotive engineers that we will conditionally withdraw the offer for a new modernized, time-based collective agreement. That time-based agreement proposal was intended to address the union’s concerns related to work and time off scheduling, while allowing significant wage increases and additional customer service flexibilities.
CPKC will focus on a status quo-style contract renewal covering three years with competitive wage increases that are consistent with recent settlements with other railway unions and maintains the status quo for all work rules. The status quo-style offer fully complies with new regulatory requirements for rest and does not in any way compromise safety.
For the TCRC – RCTC division, CPKC has also proposed a renewed agreement with the rail traffic controllers which would deliver competitive wage increases

UPDATE ON TCRC COLLECTIVE BARGAINING NEGOTIATIONS
Today, the Canada Industrial Relations Board (CIRB) informed CPKC that it intends to issue its decision regarding the Ministerial Referral on the maintenance of activities by Friday, August 9. The CIRB has advised it will issue a decision without holding oral hearings.
This development helps provide some predictability regarding the timelines for a potential work stoppage because the parties cannot legally strike or lockout prior to the CIRB issuing its decision. In any event, a legal strike or lockout would require a minimum of 72 hours notice, subject to any extension of the cooling off period ordered by the CIRB. We have asked the CIRB to extend the cooling off period by 30 days.
We know supply chain stakeholders would like certainty and predictability concerning a potential work stoppage. That is also why CPKC has proposed to the TCRC that we resolve this labour dispute through binding arbitration.

CALGARY, AB, May 16, 2024 /CNW/ – Canadian Pacific Kansas City (TSX: CP) (NYSE: CP) (CPKC) today published the following update on collective bargaining with the Teamsters Canada Rail Conference (TCRC):
CPKC and the TCRC leadership will resume meeting on May 17, 2024 with the assistance of federal mediators in an effort to achieve new collective agreements for our Train and Engine (T&E) and Rail Traffic Controller (RCTC) employees.
As we have said since these negotiations began, CPKC is firmly committed to the collective bargaining process and our objective remains to negotiate renewed agreements that are in the best interests of our employees, their families, our customers, the Canadian economy and North America’s supply chains.
We recognize that the Federal Minister of Labour’s referral to the Canada Industrial Relations Board (CIRB) has created uncertainty regarding the timing of a potential work stoppage and corresponding interruption of rail service on our Canadian network. While it remains unclear how long it will take for the CIRB to issue a decision, this is what we know today:
We are committed to keeping all stakeholders updated as this process unfolds and will provide updates at least every two weeks or more frequently as necessary.
We wanted to reach out and give the latest update regarding the CPKC and CN negotiations. The Ministry of Labour has now involved the Canada Industrial Relations Board (CIRB) to determine if, contrary to the agreement reached by the railway and the unions, any rail activity must continue during a strike or lockout to protect the health and safety of Canadians.
This involvement means a legal strike or lockout cannot occur until the CIRB renders its decision, which is unknown at this time.
Therefore, no strike or lockout will happen on May 22, 2024 and it will be business as usual.

An incident involving a CPKC derailment occurred on the Brooks Subdivision southeast of Calgary, Alberta on evening of Monday February 5th. There were no reported injuries. However, a number of Fastfrate containers were impacted by the event.

Western Canada branches are now back to regular operations. Our teams have been working to get through all delays caused by the weather and are back to picking up and delivering all scheduled shipments.

Customer Bulletin – Extreme Cold Weather
The extreme cold weather is still affecting parts of Western Canada with active winter storms and snow in parts of BC, making it difficult for our drivers to stay out for long periods of time and trucks to safely be on the roads. The safety of our drivers is very important to us.
Service delays are in still in affect across Western Canada with Vancouver, Calgary and Regina seeing a 48–72-hour delay. Our operations team are working to ensure there are minimal delays but can not guarantee pick up and deliveries as the extreme weather continues throughout this week.

Parts of Western Canada is experiencing extreme cold weather conditions some locations are experiencing -40°C to -50°C degrees temperatures making it difficult for our drivers to stay out for long periods of time. The safety of our drivers is very important to us.
These adverse cold conditions may result in service delays of freight moving throughout Western Canada. Our operations team are working to ensure there are minimal delays but can not guarantee pick up and deliveries as the extreme weather continues throughout this week.
